CASE

ADOPTION OF RURAL DEVELOPING INTERIM ORDINANCE;
CASE OF CITY OF RAMSEY
By: Patrick Trudgeon, AICP, Assistant Community Development Director
Amy Geisler, Associate Planner

Background:

At the April 5th, 2004 work session, the City Council discussed a proposed interim ordinance that
would place a 90-day moratorium on platting and subdivision in the R-1 Rural Developing
Zoning District. At the work session, Council directed staff to prepare an ordinance for
introduction and advertise for a public hearing.

At a recent Strategic Planning session, the City Council discussed the need to amend the 2001
Comprehensive Plan to more effectively plan for residential development outside of the current
urban service area. The City Council held a joint meeting with the Planning Commission on
March 16th, 2004 to discuss the need to amend the Comprehensive Plan. There was general
consensus among Council and the Planning Commission that this planning process should begin

soon.

One concern expressed by Council (and shared by staff) is that additional 2.5-acre residential
development may be initiated under current zoning regulations before the Comprehensive
Planning process is complete. It is staff's opinion that such development may further complicate
sewer and water extension scenarios, and ultimately make the comprehensive planning process
more difficult.

The following items are enclosed for your informatiOn:

a) Moratorium map exhibit
b) City Council work session minutes dated April 5, 2004
c) Proposed interim ordinance

Notification:

The public hearing was properly advertised in the Anoka County Union. staff also sent a public
hearing notice and map to owners of parcels 5 acres or larger in the Rural Developing District. A
public hearing was held by the City Council on April 27, 2004

Observations:

As written, the proposed interim ordinance would prohibit all platting and subdividing in the R-1
Rural Developing Zoning District. The ordinance does allow for exceptions, based on hardship.
