-Draft - <br /> <br />Development Agreement for Mr. Eliot Schaeffer <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />i7. Land and Cash Contribution. The Plat is located in the Demerest Brook <br /> Recreation District. The existing parcel is 21.46 acres. The Plat will have 3 <br /> parcels, Parcel A - 2.50 acres around the existing homestead, Parcel B and <br /> creating a new 18.96 acre parcel with the intent of building 1 house on the new <br /> parcel. The existing homestead is exempt from Park dedication. The park <br /> dedication requirements for the new parcel are 1.89 acres of land (0.1 - 3 units/ <br /> acre- 10% land, 2004 rate) or a cash payment of $2200 per buildable lot. The <br /> applicant is proposing to dedicate 1.01 acres of land as park. This is 53% of the <br /> park dedication requirement. The remainder of the park dedication shall be met <br /> by a cash donation of One Thousand Thirty Four Dollars and no cents ($1034.00). <br /> The land to be dedicated is entirely north of Trott Brook and will create a Parcel C <br /> with out direct access to a public road. <br /> <br />Recognizing the desire of the Mr. Schaeffer to maintain access for use of this <br />Parcel C the following language is added to this development agreement: <br /> <br />Limited crossing of the park land by recreational or utility type vehicles, from <br />Parcel B to Parcel C will be permitted provided that: <br /> <br />1. Both parcels continue to be owned by Eliot and Debborah Schaeffer or their <br /> direct heirs. <br /> <br />o <br /> <br />An easement is drafted by the Schaeffer's at their expense and approved by <br />the City setting forth the terms of this exclusive and conditional easement <br />within one year of the recording of the Development Agreement. <br /> <br />3. Conditions of this easement shall: <br /> <br />a. Prevent the use of any motorized vehicles in a manner that contributes <br /> to erosion or is unduly detrimental to natural resources. <br /> <br />b. That adequate insurance is maintained by persons benefited by the <br /> easement for uses of said easement. <br /> <br /> Said easement shall sunset at either the sale of Parcel. B to anyone not <br />a direct heir of Eliot and Debborah Schaeffer, the resubdivison of <br />Parcel B, or at such time as the City may have in place a hard surface <br />trail on any portion of Parkland that is a result of this Development <br /> <br /> <br />
