Councilman Cox added that Berg Oil had dec0ratedthe front of their business
far more than expected and he has no problem with deleting the aggregate
from the accessory building.

Ron West indicated that he should have submitted reviewed plans to be a part
of his development contract and then this misunderstanding could have been
avoided.

Motion by Councilman Cox and seconded by Councilman Mickelson to refund
$761.15 of the escrow amount to Ron West and eliminate the requirements
of the aggregate front from' the development contract.
The appropriate changes a~re to be made in the contract and the minutes
to reflec~ the change.

MINNESOTA UTILITIES SITE PLAN FOR GOUNCI]~ APPROVAL

Lloyd Bear1 of Minnesota Utilities' was present..
ASministrator Schnelle explained the problem that the Planning and Zoning
Commission had with this plan.

The parcel is landlocked.

Mayor Gamec said that this issue had been discussed when Ramsey 67 plat was
approved. W~enever the parcel in the rear is developed then they and the
others would have to develop the road. Further, that before any further
development, the road would have to be put in. He said that Outlot B and
Lot 1 would be served by Tungsten Street. That he understood that Outlot
B was to become part of Tract B and that there would be no building on
Outlot B until the Tungsten Street is improved.

Councilman Cox stated that this is an existing business that is being
adde8 to and not another piece of property. He did not see that what is
being proposed would hav~ a great deal of affect on anything anymore than
what exists there already.

Co~mcilman Mickelson added that the easement is presently being utilized as
access to this business.

Councilman Cox noted that the septic system as indicated on the site plan
was placed incorrectly.

Mr. Bearl said that it was in error and that it will be located to the north
on the Industry Avenue side of the property.

Motion by Councilman Cox and seconded by Councilman Sor~eberg~to grant
a variance to Minnesota Utilities to use the eaSement on the east side of
the property as access to their business.

Motion carried.
