City Attorney Goodrich said the city has an absolute responsibility <br />to show that citizens are benefittirgby a street improvement and <br />if anyone doesn't think they are benefitting, they can appeal the <br />city's decision in court. <br /> <br />Councilman Cox said the residents should understand that this project <br />is a proposal, that the City Council also has reservations and that <br />a decision has not been made yet. He said this public hearing is <br />for the City Council to hear the citizens' comments and feelings <br />about this proposal. <br /> <br />Mr. August Grosslein, 13554 Tungsten St. <br /> <br />Mr. Grosslein said when they put in the storm sewer, they did it to <br />protect their property. The water is not running off into the drain. <br />He said if the corner of Rivlyn & Tungsten doesn't get repaired, <br />there is going to be the same problem next year. The street has to <br />be graded down to do the storm sewer any good. <br /> <br />Mr. Dickenson Jr. said the road was good and useful before the commercial <br />development came in and he didn't feel the residents should have to <br />take caze of that problem. <br /> <br />Mr. Grosslein said there is going to be commercial and residential <br />there and the citizens are going to have to live with both. He <br />suggested making a commercial road and a residential road. <br /> <br />Mrs. Minnie Dickenson asked who would be paying for the upgrading of <br />Tungsten Street. <br /> <br />Mayor Gamec said the one paying for the upgrading of Tungsten Street <br />could possibly be Grosslein and the corner property and it could be <br />all those benefitting. <br /> <br />Mr. Dickenson Sr. asked how much the Mayor estimates it will cost. <br /> <br />Mayor Gamec said he couldn't tell him that at this time. <br /> <br />Mr. Jack Newcom~, 6301 Rivlyn Avenue <br /> <br />Mr. Newcomb said he agreed there is a problem, but he didn't think <br />it should be done until sewer & water comes in. <br /> <br />Motion by Councilma~Cox and seconded by Councilman Reimann to adjourn <br />the public hearing. <br /> <br />Motion carried. Voting yes-Mayor Gamec, Councilmen Sorteberg, Reimann, <br />Mickelson and Cox.
