Mr. Dohrn - Attorney for Wes Bulen - In reviewing previQus <br />minutes, 167th and #47 should be looked at again. We feel <br />the cost is a legitimate city expense. Mr. Bulen is not <br />waiving the 45 day time period. <br /> <br />Mr. Goodrich - After the motion was passed last November 10, <br />concerning this issue, City Hall sent each of these gentlemen <br />(Stephen Schmidt and Wes Bulen) a copy of the resolution <br />along with a request for payment and agreement to waive 45 <br />day time period. Mr. Bulen never waived. Ordinance states <br />that Council shall act within 45 days. It is not an automatic <br />approval if Council does not act within 45 days. Theoretically, <br />what Mr. Bulen is saying is that if you don't grant him the <br />rezoning, he will go to court. <br /> <br />Mayor Gamec - If Mr. Bulen did take us to court, I would have <br />to deny rezoning because this is an important corner and it <br />will take some time to make a decision. <br /> <br />Mr. Sorteberg - I feel I could be more objective in this case, <br />if the City picks up the cost of the planner. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember <br />sorteberg to authorize the City of Ramsey to engage Gunnar <br />Isberg to review and submit a report on the rezoning of Mr. J. <br />Stephen Schmidt's 5.5 acres of land located at the intersection <br />of. Itighway #47 and 167th Avenue N.W. from R-1 to B-1. Further, <br />that the City of Ramsey pay the $875 cost of the planner. <br />Further, to rescind adoption of Resolution #81-185, adopted <br />November 10, 1981. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cox, <br />Reimann, Sorteberg and Van Wagner.
