1912280 <br /> <br /> P_m-3 id-- <br />Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION # 03-11-307 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />FOR AN OVERSIZED ACCESSORY BUILDING BASED ON FINDINGS OF FACT <br />#0659 AND DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, Don Volner (Permittee) has properly applied for a conditional use permit to <br />exceed the accessory building size restriction for properties located outside the Metropolitan <br />Urban Service Area (MUSA) established in section 9.11.02 "Accessory Uses" of City Code on <br />the property generally known as 8121 154th Avenue NW and legally described as follows: <br /> <br />Lot 4, Block 13, Whispering Pines Estates, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on November 6, 2003, conducted the <br />public hearling and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0659, a conditional use permit (Permit) to exceed the accessory <br />building size restriction for properties located outside the MUSA as established in City Code, <br />is hereby granted to Don Volner, hereinafter referred to as the "Permittee". <br /> <br />That the overall square footage for accessory buildings may exceed the 1,488 square foot <br />accessory building size restriction for properties between 14,880 sq. ft and 43,559 sq. ft. in <br />size by a total of 332 square feet in order to accommodate the inside storage of private-use <br />equipment and materials. <br /> <br />3. That the construction of the detached accessory building on the Subject Property shall require <br /> issuance of a building permit from the City of Ramsey, removal of the existing storage shed, <br /> and conversion of the attached garage into living space. <br /> <br />4. That the building permit will not be issued until a surety in the amount of $2,000 is submitted <br /> to ensure the removal and conversion of existing accessory structures on the property. Upon <br /> completion of the required removal and conversion of the existing accessory structures, to the <br /> satisfaction of the City, the surety shall be returned to the Permittee. <br /> <br /> <br />
