P06K Anoka Conservation District <br />1318 McKay Drive NE, Suite 300 <br />ACONSERVATION Ham Lake, Minnesota 55304 <br />0 ISTRICT Ph: 763-434-2030 Fx: 763-434-2094 <br />www.AnokaSWCD.org <br />January 7, 2015 <br />RE: WCA No -Loss Exemption for Replacement of Wetlands — building a deck <br />Mark Sutton <br />7516-163Av NW <br />Ramsey, MN <br />Block 2 Lot 19 Sweetbay Ridge <br />WCA — NO -LOSS EXEMPTION <br />The Anoka Conservation District conducted an off-site Wetland Review for the parcel identified <br />above in regard to building a deck probably within the drainage and utility easement noted on <br />the Sweetbay Ridge plat (Figure 1 Plat and Water Resources.pdf). <br />It is the opinion of the Anoka Conservation District that building a deck in the <br />drainage and utility easement and a Type 3/PEMC (inland shallow fresh marsh) <br />qualifies for a "no -loss" exemption according to 8420.0415. The exemption holds true <br />as long as the construction of the deck does not excavate, fill or drain the wetland during <br />construction or use of the deck.
