residential development, but in no case shall a property be allowed to maximize development <br />with a single use. <br /> <br />Associate Planner Wald advised it came to Staff's attention during the review of the preliminary <br />plat for Rivenwick 4th Addition that the MU-PUD has to provide a minimum of 70% residential <br />uses. It was the intention of the MU-PUD district to capitalize on properties that could provide a <br />complimentary mixture of commercial and residential uses. The proposed 70% minimum <br />residential requirement appears to be contradictory to the opening sentence of the MU-PUD <br />intent statement. <br /> <br />Associate Planner Wald stated Staff is proposing to delete the 70% minimum residential <br />requirement and replace it with the following statement; "to provide for an adequate mixture of <br />commercial and residential uses and in no case shall a development contain 100% of any one <br />use". She indicated Staff is recommending the Planning Commission provide a positive <br />recommendation to the City Council to introduce and adopt the MU-PUD ordinance with the <br />suggested language change. <br /> <br />Citizen Input <br /> <br />Mr. Holasek clarified the ordinance currently says it has to be 70% residential. <br /> <br />Vice Chair Johnson stated the problem they were facing was that they wanted commercial to be <br />part of the mix, but the way it was written it could have been all residential. He stated this gives <br />Staff some authority to say it has to be a mixed use. <br /> <br />Associate Planner Wald added they are not capping any use, except to say it has to have at least <br />two uses. <br /> <br />Mr. Holasek stated it could be 95% residential and 5% commercial if the Planning Commission <br />deems that appropriate. <br /> <br />Associate Planner Wald agreed, indicating the City Council would also have to approve it. <br /> <br />Motion by Commissioner Van Scoy, seconded by Commissioner Jeffrey to close the public <br />hearing at 9:05 p.m. <br /> <br />Motion carried. Voting Yes: Vice Chair Johnson, Commissioners Van Scoy, Jeffrey, Brauer, <br />Shepherd, and Watson. Voting No: None. Absent: Chairperson Nixt. <br /> <br />Commission Input <br /> <br />Commissioner Van Scoy stated the comment he recalls is that the wording was a mistake, and it <br />should have said a maximum of 70% residential.
