Absent: Councilmember LeTourneau. <br />7.03: Consider Adoption of Resolution #16-01-004 Ordering Feasibility Report for <br />Improvement Project #16-36, Business Park 95 Regional Stormwater Pond Outlet <br />Improvements <br />City Engineer Westby reviewed the staff report and recommendation to approve alternate action <br />one to allow the proposed Business Park 95 regional stormwater pond outlet Feasibility Report to <br />be completed to further an improvement project that can be constructed in 2016, thereby <br />preventing delays or denials of future LRRWMO permits upon future business expansion <br />projects occurring within this business park. <br />Motion by Councilmember Kuzma, seconded by Councilmember Johns, to adopt Resolution <br />#16-01-004 Ordering Preparation of Feasibility Report for Improvement Project #16-36 Business <br />Park 95 Regional Stormwater Pond Outlet Improvements. <br />Motion carried. Absent: Councilmember LeTourneau. <br />7.04: Consider Approval of Extension of Contract for Civil Legal Services with the Firm <br />of Ratwik, Roszak & Maloney, P.A. <br />City Administrator Ulrich reviewed the staff report and recommendation to approve the <br />extension of the contact for civil legal services with the law firm of Ratwik, Roszak & Maloney, <br />P.A. with a term of January 1, 2016 through December 31, 2017. The consensus of the Council <br />in the previous work session was to consider a lower retainer amount per month, and was to <br />implement a trial period of incurring a lower retainer amount per month and lower flat fee for <br />attending meetings by requesting legal representation as needed. This trial period would begin <br />February 1, 2016, and end August 1, 2016. <br />Councilmember Kuzma commented he has concerns about not having the City Attorney at each <br />meeting. While it is potential for savings, it has potential of not having legal representation <br />when needed. <br />Councilmember Shryockexplained she will support this motion due to the potential savings. <br />She said she likes the opportunity to revert to the previous process if the trial doesn't seem to <br />work well. <br />Motion by Councilmember Riley, seconded by Councilmember Williams, to approve extending <br />the contract for civil legal services with the law firm of Ratwik, Roszak & Maloney, P.A. for the <br />City Council / January 11, 2016 <br />Page 10 of 11 <br />
