Board of Adjustment 5/9/77 <br /> <br />BOARD OF ADJUSTMENT <br /> <br /> CITY OF RAMSEY <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br /> <br />A Board of Adjustment meeting was held on May 9, 1977, at Ramsey Elementary School, <br />Music Room, 15000 Nowthen Boulevard, NW, Ramsey, MN 55303. <br /> <br />Present: <br /> <br />Mayor Cox <br />Councilman Gorham <br />Councilman Mickelson <br />Councilman Muller <br />Councilman Reimann <br /> <br />A1 so Present: <br /> <br />Adm. Asst. Nereson <br />Attorney Goodrich <br /> <br />Mayor Cox called the meeting to order' at 7:10 p.m. <br /> <br />Mayor Cox indicated that the purpose of the meeting was to review as proposal <br />by Mr. Grosslein and a request from Robert Muller. <br /> <br />Mr. Nereson made the comment that Mr. Grosslein withdrew his request at this <br />time. It was decided at a meeting between Mr. Grosslein, his attorney, Attorney <br />Goodrich, and Mr. Nereson that more information should be available for discussion. <br />It was decided that a meeting with the Roger Dickensons of Elk River, their <br />attorney, Attorney Goodrich and Mr. Nereson should be held to discuss the road <br />in question and regulations pertinent to it. <br /> <br />The next item was in reference to a request by Robert Muller to be allowed <br />to have a 15' rear yard behind his new building instead of 30'. After much discussion <br />Councilman Gorham moved to adopt the findings of fact whi~ch were that the Board of <br />Adjustment finds the following: <br /> <br />1. The City of Ramsey Zoning Ordinance No. 73-5 calls for a rear-yard set back <br /> of 30 feet. <br /> <br />2. The applicant has requested a dimension to allow construction with a fifteen <br /> foot rear yard set back. <br /> <br />3. The applicant requests this dimension variance to allow future expansion of <br /> the building. <br /> <br />Relative to the size of the lot and the proposed size of the building combined <br />withme resulting number of parking spaces as required by the zoning ordinance <br />strict enforcement of the 30 foot rear yard would not allow future expansion <br />proposals. <br /> <br />o <br /> <br />The City Council has before it a recommendation from City planning staff to <br />reduce the number of parking spaces by 50 percent for this type of business and <br />if this criteria were in effect it would eliminate the need for a dimension variance. <br /> <br />Based on the above findings and testimony at the Board of Adjustment meeting, the Board <br />of Adjustment finds: <br /> <br />1. Literal enforcement of the rear yard setback would result in unnecessary <br /> hardship with respect to the property. <br /> <br />2. Such unnecessary hardship results because of unique circumstances of the property. <br /> <br /> <br />
