-2- <br />.cQ~nc¢l~7/25/77 <br /> <br />extension of time or possibly to buy additional property and <br />Attorney Goodrich has heard no further word from her. The <br />Odegaards have been served with misdemeaner complaints on 7/5, <br />7/6, 7/7, 7/8, and 7/10 and since then the police have gone out <br />and counted various amounts of dogs on the property. A period <br />of 24 days in which the City has brought counts on each of <br />those days. Odegarrd has plead not guilty to all complaints. <br />The complaint is more than three dogs on a land parcel of <br />le~s than five acres and Odegarrd requests a jury trial which <br />will probably be held in October. Attorney Goodrich said the <br />City plans to have the Court hear an injunction motion on August <br />5th. <br /> <br />Mr. Morely asked what penalties are on the Ode§aards. <br /> <br />Attorney Goodrich responded $300 a day or 90 days in jail for <br />violation each day. He said the City also had the health <br />department out there and he read their letter of response. <br /> <br />Attorney Goodrich explained the action that will be brought <br />against the Ode§aards to get the matter to court. <br /> <br />Mr. Morely was concerned that if the Odegaards bought additional <br />land would they then be able to apply for a kennel license and <br />keep the dogs. <br /> <br />Attorney Goodrich explained even with additional land they would <br />still need a conditional use permit. <br /> <br />Mr. Reynolds said he was awakened by Odegaard dogs barking at <br />1:00 a.m., and further, it has been only five nights since <br />May that he has been able to sleep through the night. <br /> <br />Attorney Goodrich instructed Mr. Morely and his neighbors to keep <br />records of when the dogs bark to have documentation when this <br />goes to court. <br /> <br />Mr. Gustafson, 6256 Rivlyn, was in attendance to express his <br />concern about the new N & N Auto Body building being constructed <br />in his neighborhood. He presented Council with a leter containing <br />items he feels to be in violation of City ordinances and pictures <br />he took relative to that matter. He said there are residences <br />that have to go into that street, they are losing $300,000 to <br />$350,000 in property value, it is affecting the general well <br />being of their area and it is a safety hazard to their children <br />because of Council's policy. He also voiced a complaint concerning <br />Grosslein's violations. <br /> <br />Mr. Nereson responded that the Council does realize the problems <br />in that area and is greatly concerned and has been for sometime <br />about areas along Highway 10. The City is in the process of <br />enforcing strict compliance on these businesses. He said N & N <br />Auto Body is commercially zoned and their building is building <br />code approved and the staff saw little possibility in refusing <br />the permit. Screening negotiations for N & N Auto Body were <br />started today. <br /> <br /> <br />
