Board of Adjustment 5-8-78 (3) <br /> <br />That the variance observes the spirit and intent of this ordinance, <br />produces substantial Justice and is not contrary to the public <br />interest, <br /> <br />Based upon the above findings of fact th, Board ofAdjustmenthereby grants the <br />variance to the petitioner, contingent upon the following conditions: <br /> <br />That any additional run-off created by the proposed build,rs be drained <br />to the East of the property, and that accordingly, proper drainage <br />facilities be provided in accordance with the City Engineer's recommenda- <br />tions, if natural drainage and run-off will not occur. <br /> <br />That the applicant shall absorb the City's cost in acquiring an 8' <br />by 200' piece of Parcel 1480 which 8' x 200' piece of property is <br />directly adjacent to the applicant's property (Parcel 1520). That <br />the applicant may, if he desires the variance prices to the City's <br />formal acquisition of Ail of Parcel 1580, pay into a City escrow fund <br />a sum one and one half times the market value, as determined by the <br />County assessor's office records relating to Parcel t~80, of this <br />specific 8' x 200' parcel. 5 Ayes <br /> <br />MOTION by Mickelson, seconded by Reimann to adjourn the Board of Adjustment. 5 Ayes <br /> <br />Adjournment 9:53 P.M. <br /> <br /> <br />
