CITY COUNCIL WORK SESSION <br />Topic Report: Noise/Nuisance Ordinance Discussion <br />By: Jim Way, Police Chief <br /> <br />Background: <br /> <br />In recent months, Council members have been receiving complaints from citizens concerning <br />noise fi'onq various sources. One of the main sources of the noise being generated has been <br />through the use of ATV's and mini-bikes. The PD has been receiving the noise complaints along <br />with violations of our trespassing laws being committed by motorized vehicles. <br /> <br />Staff has looked at several (9) surrounding communities to see how they are handling the <br />problems in dealing with both types of complaints. As expected, there were no two cities that <br />have the same ordinance. Some cities restrict the use of motorized vehicles within their cities by <br />restricting where they can be used. Elk River for example, has what they call a "No ATV Zone". <br />Sherburne County restricts the use by indicating that the use must be a minimum of 1000 feet <br />from any residence other than the owners. Some of the cities simply restrict the use by a <br />statement much like our current ordinance, which basically says, if it annoys you, it is disturbing. <br />Three cities use the State decibel level standard as their guideline. <br /> <br />Staff would like Council to discuss which direction the City should take in dealing with <br />motorized vehicles. Should staff work on the permitted use or non-use of the motorized vehicles <br />or does staff look at the noise that they create. There are pros and cons to both choices that will <br />be discussed. <br /> <br />Action Statement: <br /> <br />Based on Council discussion and recommendation, staff will bring back proposal for <br />consideration. <br /> <br />Reviewed by: <br />Police Chief <br /> <br />CCWS: 05/18/04 <br /> <br /> <br />
