CITY COUNCIL WORK SESSION
Topic Report: Noise/Nuisance Ordinance Discussion
By: Jim Way, Police Chief

Background:

In recent months, Council members have been receiving complaints from citizens concerning
noise fi'onq various sources. One of the main sources of the noise being generated has been
through the use of ATV's and mini-bikes. The PD has been receiving the noise complaints along
with violations of our trespassing laws being committed by motorized vehicles.

Staff has looked at several (9) surrounding communities to see how they are handling the
problems in dealing with both types of complaints. As expected, there were no two cities that
have the same ordinance. Some cities restrict the use of motorized vehicles within their cities by
restricting where they can be used. Elk River for example, has what they call a "No ATV Zone".
Sherburne County restricts the use by indicating that the use must be a minimum of 1000 feet
from any residence other than the owners. Some of the cities simply restrict the use by a
statement much like our current ordinance, which basically says, if it annoys you, it is disturbing.
Three cities use the State decibel level standard as their guideline.

Staff would like Council to discuss which direction the City should take in dealing with
motorized vehicles. Should staff work on the permitted use or non-use of the motorized vehicles
or does staff look at the noise that they create. There are pros and cons to both choices that will
be discussed.

Action Statement:

Based on Council discussion and recommendation, staff will bring back proposal for
consideration.

Reviewed by:
Police Chief

CCWS: 05/18/04
