Ralph Hendrickson - 5460 140th Lane N.W. - Agreed with Mr. Data's comments.
Stated that Mr. Carson promised that Flintwood I would be bermed from
Flintwood II; it was never done. The site preparation mess from Flintwood
II was never cleaned up. There is not sufficient parking areas for the
number of residents in Flintwood II; the parking overflows comes into
Flintwood I; parking needs in Flintwood 5th would be even greater. Mr.
Carson has not built the style or variety of homes in the area that was
promised.

Dyann Hendrickson- 5460 140th Lane N.W. - Inquired as to the purpose of
this public hearing when the Flintwood PUD was settled in 1983 and why do
the residents have to take the time to fight for what was supposed to have
been taken care of with the development of the Flintwood PUD. Inquired as
to the whereabouts of minutes from a meeting between developers of
Flintwood PUD, residents of Flintwood I, and members of Planning and Zoning
Commission, City Council and City Staff; she has been told by staff that
the particular minutes and agreen lost.

Mr. Goodrich stated that the city has all the minutes from public meetings;
no public meeting minutes are lost. This area is in public hearing again
because the developer has the right to request discussion and/or change to
what was granted initially; the system allows for everybody to be heard,
regardless if it is approved or not.

Mr. Stan Data submitted a written statement from John Lichter (see
Attachment A/.

Duane Olson - 5520 140th Lane - Stated his daughter bought a home from Dick
Carson on one of the cluster lots at 14089 Dysprosium; Barnett came im and
built a house and put the driveway 10 feet from his daughter's front door;
who surveyed the area and where was the building inspector?

Chairman Zimmerman admitted there have been problems in the area of
building inspection that Council has not addressed.

Mr. Goodrich stated that the example sited by Duane Olson should be checked
out before there is any agreement or disagreement that wrong has been done.

Mr. Carson admitted that the cluster home portion of the development did
not turn out as well as expected and even though the ~oning was there, that
type of development was ceased after the first phase. Mr. Carson stated
that the developers made the choice to develop smaller multi-family
buildings and an office building on these outlots because it would be a
better type of development adjacent to Flintwood I and on an MSA road than
the higher density that area is currently zoned for. Mr. Carson stated it
is not the intention to remove trees. If there was an agreement between
the City and NDH for a berm between Flintwood I and II, assume there are
funds for that being held in escrow per the development contract. A
homeowners association was imcorporated with the State of Minnesota and
transferred to the builders that purchased the lots; the association covers
snow removal and driveway maintenance; it does not address lawn care.

Mr. Goodrich reviewed the contents of the terms of the development
P & Z/Public Hearing/December 1, 1987
