satisfy frost footing requirements; 5) will not develop on that additional <br />7 feet of property needed by the city for future construction of Front <br />Street in exchange for a variance to setback now necessary because of <br />additional easements needed and will deed that easement to the city when it <br />becomes necessary; 6) would like a 30 foot variance to the 35 foot rear <br />yard setback so that the 3 new buildings will be placed uniformly with the <br />3 existing buildings on Lot 2 and both lots would be accessed on the <br />northwest side of Lot 1 from 138th and the Ebony access closed. <br /> <br />Ms. Norris noted that with the additional 7 feet of easement needed, a <br />variance would not be necessary if the property were developed fronting on <br />Ebony and side yard on 138th. <br /> <br />Mr. Dubats stated he paid more for this particular lot because an entrance <br />to the business on 138th would be visible from Hwy. #10. Mr. Dubats stated <br />that he would be willing to deed the additional 7 foot easement required if <br />he could have is business access from 138th. <br /> <br />Commissioner Shumway stated that how the access from 138th would relate <br />to Hwy.#10 stacking distance should be reviewed by the County and the <br />State. <br /> <br />Mr. Goodrich suggested that the City Engineer and Building Official review <br />whether or not a reinforced slab satisfies frost footing requirements. Mr. <br />Goodrich stated that legally there can be a common driveway for two <br />separate lots of record by way of a variance; common driveway makes good <br />planning sense. <br /> <br />The Commission proceeded to review the proposed findings of fact. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Rolm to recommend <br />that City Council adopt findings of fact relating to Mr. Bill Dubats' <br />request for a conditional use permit with the following amendments: <br /> <br />Item #11 should read as follows: 'That the proposed use will increase <br />traffic into and from the subject property.' <br /> <br />Add Item #21 to read as follows: 'That written comments were received <br />from Mr. Joseph Sentyrz dated October 30, 1987 indicating no objection <br />to the construction of a self-service storage facility as long as the <br />owners are required to build a building that at least meets or exceeds <br />the standards imposed on other commercial development in the area.' <br /> <br />Motion carried. Voting Yes: Vice Chairman Hendriksen, Commissioners <br />Shumway, LaDue, Holm and Terry. Voting No: None. Absent: Chairman <br />Zimmerman and Commissioner Howell. <br /> <br />The Commission proceeded to review the proposed conditional use permit. <br /> <br />Mr. Dubats stated that he feels requiring an escrow for blacktopping is not <br />necessary as blacktopping is a very essential amenity to the business and <br />is a task included in the 6 week construction period. <br /> <br />Mr. Goodrich stated that the escrow assures the city that required <br />improvements will be completed; escrow will be required at the time the <br />building permit is pulled and returned when the project is complete. <br /> P & Z/November 3, 1987 <br /> <br />Page 4 of 7 <br /> <br /> <br />
