The Commission reviewed the letter from the County Engineer dated October 6,
1987 regarding access for the lots. Lots 1 and 2 will access on to 173rd
Avenue N.W. and Lot 3 will access on to Armstrong Boulevard N.W. Chairman
Zimmerman noted that the new alignment for County Road 83 lies southwest of
the Tranbys' plat.

Motion by Commissioner LaDue and seconded by Commissioner Holm to recommend
approval of Mr. and Mrs. Tranby's minor subdivision, incorporating the
comments of the County Engineer.

Motion carried. Voting yes: Chairman Zimmerman, Commissioners LaDue,
Holm, Shumway and Terry. Voting no: None. Absent: Commissioners Howell
and Hendriksen.

Case ~3:

Com~ider Amendment to_ Section 170.017 of the City Cod~
Establishing Performance Standards for Grading. Mining and
Excavating Operations:

City Attorney Goodrich reviewed the revision dated October 20, 1987 to the
proposed ordinance. The revision includes a discussion of how haul roads
are to be designated.

Mr. Art Raudio asked what prompted this ordinance. City Attorney Goodrich
stated that the City has recently processed many conditional use permit
applications for grading and mining and the Council would like to have
uniform standards that apply to all such operations.

Mr. Raudio noted that the proposed ordinance would require existing
operations to comply with the requirements of the ordinance within 180 days
of adoption of the ordinance; this appears to be revoking those existing
permits which he thought were perpetual. Mr. Raudio also stated that he
was concerned about the expense of completing all the requirements
specified in the proposed ordinance.

Chairman Zimmerman asked whether Mr. Raudio believed that existing
operations should be grandfathered in. Mr. Raudio stated that those
operations that meet the City's existing standards should be allowed to
continue operating.

Chairman Zimmerman asked Mr. Raudio to submit any comments he has regarding
the proposed ordinance for the Commission's discussion prior to the next
Commission meeting. Chairman Zimmerman noted that the public hearing on
the proposed ordinance is continued to 7:30 p.m., Tuesday, November 3,
].987.

Case #4:

Consider Amendment to Chapter 110 of the City Code
Establishing Regulations and Zoning Districts for Keeping
Animals ~

City Attorney Goodrich reviewed the intent of the proposed ordinance.
Commissioner LaDue asked whether the State requires a minimum lot size for
licensing wild animals. Chairman Zimmerman noted that his concern is with
the primary and secondary enclosures.
Planning & Zoning Commission/October 20, 1987

Page2 of 4
