Another possiblity is for the local community to <br />negotiate with the landfill owner a payment to cover street repairs that are <br />needed beyond those normally expected. If the landfill is publicly owned, the <br />county could or maybe should assume responsiblity for the road. <br /> <br />Indirect Costs <br /> <br />AMM identifies several indireCt'costs that fall upon the host community such as <br />litter control, monitoring and inspection costs. Certainly, litter control can <br />be negotiated between the community and landfill. Currently, monitoring and <br />inspection costs fall upon the state, county or landfill owner. The MPCA and <br />counties are responsible for inspecting the landfill'for compliance with state <br />and county regulations. Furthermore, the costs for monitoring (samples from <br />monitoring wells) the groundwater fall upon the landfill owner. However, <br />problems arise whenever the level of enforcement is below the host community's <br />expectations. However, the WMA states, "With the approval of-the Council, <br />local government units may impose and enforce reasonable Conditions respecting <br />the construction, operation, inspection, monitoring and maintenance of the . <br />disposal facilities." The Council reviews any proposed ordinances or <br />restrictions with criteria in its Solid Waste Policy Plan (pages 59 and 60). <br />Local governments could recover some of the costs of enfo'rcement activities by <br />charging an annual fee for a permit. <br /> <br />A potential conflict of interest may occur if a county both owns and operates <br />the landfill and remains responsible for regulating its operation. In such <br />cases, it may be desirable for the local community to inspect the facility for <br />compliance with state and local regulations. <br /> <br /> <br />
