No permit shall be issued for the erection of any building on any tract of ]and described by metes and bounds and consisting of less than five (5) acres and having a width of less than three hundred (300) feet. 170.0315 FINAL PLAT RESUBDIVISION Resubdivision of any single lot ~en allowed by the city's zoning ord- inance can be accomplished in accordance with the resubdivision plan as required in Section 17~038Gherein, by submission of a final plat and approval of the city council. The sketch plan and preliminary plat proceedings will not be required for a resubdivision under this section. 170.0316 VARIANCES 170.05] 6A HARDSHIP The city council, may grant a variance from the requirements of this chapter as to specific tracts of land where it is shown that by reason of topography or other physical conditions, strict compliance with these requirements could cause an exceptional and undue hardship to the enjoyment of a substantial property right; provided, that a vari- ance may be granted only if the variance does not adversely affect the spirit and intent of this chapter. 70.03] 6B PROCEDURE Written application for a variance sball be filed with the zoning officer, on forms supplied' by the city, and shall state fully all facts relied upon by the applicant. The application shall be supple- mented w~th maps, plans or other data which may aid in an analysis of the matter. The application shall be referred to the planning commission for ~ts recommendation and written report to the city council for its final action. A fee shall be charged for variance applications as set by city council resolution. 170.0316C CITY (DUNCIL A(~ION No variance shall be granted by ~he city council unless it shall have received the majority vote of the council. The city council sba]] make written findings and conclusions of its action on the variance app]JcatJon, which findings and conclusions shall be recorded in the com~('il's official m~nutes.
