Contracting <br />167th Avenue N.W. Project <br /> <br />i <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Dear Council Members: <br /> <br />At your council meeting on January 25, 1983, I presented Pay <br />Estimate No. 5 on the above referenced project. This estimate was <br />approved so it could be forwarded to the state for release of MSAS <br />funds. The City of Ramsey should be receiving MSAS funds for that <br />project in the next several days. <br /> <br />In accordance to Pay Estimate No. 5, the contractor has completed <br />$218,465.59 of work on the project. BY retaining five percent <br />($10,923.28) as allowed by State Statutes, the contractor's total <br />payment due amounts to $207,542.31. To date, the contractor has <br />been paid $180,000.00; therefore, I would recommend payment of <br />$27,542.31 upon receipt of MSAS funds. <br /> <br />It is our opinion that the $10,923.28 retainage is adequate to <br />protect the City from loss due to defective work or failure to <br />clean up the project. In addition to the retainage, the City has <br />a performance bond from the Travelers Indemnity Company, which <br />binds both the Travelers Indemnity Company 'and U.D.
