,~ ~ u m ~ ~ ASSOCIATION <br />~22~5T LI~LE CANADA ROAD SUITE 222 812~2~BTfi <br /> <br /> ~ February 2, ~983 <br /> <br />I <br />I <br />I <br />I <br />I <br />,I <br /> <br />I <br />I <br />I <br /> <br />RE: LOCAL CONTROL OF THE LOCATION OF MANUFACTURED HOUSING <br /> <br />Dear Public Official: <br /> <br />In response to the numerous inquiries made by cities, counties, <br />and townships concerning the 1982 Manufactured Housing Legisla- <br />tion, the attached summary is provided to assist governmental <br />units in preparation of zoning ordinance amendments <br /> <br />The 1982 Minnesota Legislature passed a law that amended <br />Minnesota Statutes 462.357, Subdivision 1 (Municipal Planning <br />Act) stating that, "No regulation may prohibit...manufactured <br />homes built in conformance with Minnesota Statutes, Section <br />327.21 to .35 that comply with all other zoning ordinances <br />promulgated pursuant to the section." <br /> <br />The manufactured housing industry has made very significant <br />strides in recent years to improve the quality of its housing. <br />Since 1972, the industry has been building homes that had to <br />meet state building code (until 1975), or HUD construction and <br />safety standards since 1976. Manufactured homes built since <br />1976 are generally more fire resistant and better insulated <br />than state building requirements for site-built homes. The <br />1982 legislation prohibits unfair discrimination against HUD <br />certified manufactured housing and requires that manufactured <br />homes be treated like any other single-family dwelling in <br />local zoning ordinances. The 1982 legislation should be view- <br />ed as an opportunity to provide safe, affordable housing <br />within your jurisdiction without adversely affecting the <br />character of your existing neighborhoods. <br /> <br />The members of the Minnesota Manufactured Housing Association <br />and myself are available to make slide presentations and pro- <br />vide additional background information to your governing <br />body and/or staff upon request. The association and staff are <br />familiar with local concerns relating to the legislation.
