I I I I I I I I I I I I I I I - 30 - of this chapter, the City Council may waive such compliance by adoption of a resolution to that effect and the conveyance may then be filed or recorded. 170.0312C CIVIL PENALTY Any owner or agent of the owner of land who conveys a lot or parcel in violation of the provisions of thiB section shall forfeit and pay to the City a penalty as proscribed. The City may enjoin such conveyance or may recover such penalty by a civil action in any court Of competent jurisdiction. 170.0313 PLATS PREVIOUSLY RECORDED Ail preliminary or final plats, registered land surveys or other subdivisions of land approved but not filed under previous ordinances shall be subject to all requirements of this chapter hut will be reviewed separately on their own merits. 170.0314 PERMITS 170.0314A IMPROVEMENTS Ail electric and gas distribution lines or piping, roadways, walks and other similar improvements shall be constructed only on a street, alley or other public way or:e~sement which is designated on an approved plat, is properly indicated on the official map of the City or which has otherwise been approved by the City Council. 170.0314B ACCESS No permit for the erection of any building shall be issued unless such building is to be located upon a parcel of land abutting on a street or highway which has been designated on an approved plat, is on the official map of the City or which has been otherwise approved by the City Council. This limitation on issuing permits shall not apply to planned unit developments approved by the City Council pursuant to the City Zoning Code. 170.0314C LIMITATIONS No building permit shall be issued for the erection of any building on any land conveyed in violation of the provisions of this chapter. No permit shall be issued for the erection of any building on any tract of land described by metes and bounds and consisting of less than twen~ty (20) acres and having a width of less than five hundred feet (500'). 170.0315 FINAL PLAT RESUBDIVISION Resubdivision of any single lot when allowed by the City's zoning ordinance can be accomplished in accordance with the resubdivtsion plan as required in Section 170.038G herein, by submission of a final plat and approval of the City Council. The sketch plan and preliminary plat proceedings will not be required for a resubdivision under this section.
