MEMORANDUM <br /> <br />TO: CAB Facility Committee <br /> <br />F~6M: Jim Barton <br /> <br /> METROPOLITAN COUNCIL <br />300 Metro Square Building, Saint Paul, Minnesota~5.1~. <br /> <br />SUBJECT: Progress Report - EAW Review by Minnesota Pollution Control Agency <br /> <br />It appears that we are in the home stretch in the construction of the CAB <br />facility. One final hoop that remains is the issuance of a construction permit <br />by PCA. The agency will be reviewing the EAW at its meeting on Tuesday, <br />May 24, around 3:30 p.m. Dan Hartman and Grady Boeck are making arrangements <br />for local officials to be present should the need arise to testify. <br /> <br />My discussion with PCA staff on Friday indicated that they are not raising any <br />issues so that the review by the PCA board is expected to be straightforward. <br />MWCC received one response to the public hotice filed in the state register and <br />it was from DNR. The agency raised several concerns Fegarding the potential <br />elimination of several marginal wetlands (from a classification standpoint). <br />Fred Stenborg indicated that they could be restored by the contractor after <br />construction through the affected areas is completed. At any rate the concern <br />should not be significant enough to require an EIS. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />So what happened to PCA's staff concerns about dry weather flows and the <br />Minneapolis East you might ask. The concerns did not just go away, but were <br />addressed through a series of meetings between PCA, the MWCC and Council <br />staffs. The MWCC staff studied the problem of dry weather flows and documented <br />its findings in a report to PCA. A copy is enclosed. The MWCC findings stated <br />that with the CAB on line by early 1985 and the Mineapolis East not built~ the <br />affected reach of the Mississipi could experience a dry weather bypass for a <br />one-day period around 1988. This event would occur without any flow regulating <br />devices --i.e., no additional improvements to the system. The 1988 date <br />represents a pessimistic scenario, since it assumes no construction grants <br />would be available for this facility. <br /> <br />As a result of this study and a lot of persuasion, PCA agreed to the following <br />approach: <br /> <br />1. That the MWCC would monitor flows after the construction of the CAB. <br /> <br />2. That if total flows approached an agreed upon flow figure, action would be <br /> initiated for the installation of flow restriction devices such as <br /> inflatable dams. .- <br /> <br />3. That the MWCC will continue to complete Step II (plans and specifications) <br /> for the Minneapolis EaSt. Completion is scheduled for late 1983. <br /> <br />4. That no additional commitment to the construction and timing of the <br /> Minneapolis East will be required before the CAB can proceed. <br /> <br /> <br />
