I, May 9, 1983 <br /> <br />i TO: Georgo Stetnor .... . ...-.. <br /> FROM: R. <br /> <br />! <br /> The Metropolitan Council has scheduled a public meeting on TUesday, May 31, 1983 at <br />I 7:00 P.M. in the Metropolitan Council Chambers (Metro Square Building) to discuss <br /> this report. <br /> <br />IThe re~ort recommends ways of mitigating the environmental effects of waste facilities, <br />compensating communities for related risks, costs, and other adverse impacts, and iden- <br />tifies ways of financing compensation and mitigation measures. The report makes the <br /> <br />I following recommendations (these are a condensed version): <br /> 1. A compensation fund, financed by solid waste generator~ should .be established by <br /> the legislature, Legislation should also set liability standard to assure recovery <br /> of compensation for damages. <br /> <br />SUBJECT: Metropolitan Council Compensation and Mitigation Report <br /> <br />County should require landfill owner/operator to provide supplemental financial <br />guarantees to cover operational, closure, and~or post closure problems (insurance, <br />trusts,.excrows, bonds, etc.). <br /> <br />Publicly owned facilities should be required to make an annual payment in lieu of <br />taxes to each local taxing district equal to the current mill lev~ and exempt from <br />levy limitations. <br /> <br />I4. <br /> <br />Waste facility operators should oumpensate local unit of government for indirect costs <br />(disruption of planned utility service, road maintenance, litter control, monitoring, <br />end use planning, special assessments). Cities and townships should be given authority <br />to recover indirect costs fro~ landfill operators. Metropolitan Council should be <br />given authority to establish an agreement if one can not be achieved. <br /> <br />Waste fa6ility should compensate host community through negotiated contract. Metro- <br />politan Council should be given authority to mandate payment mechanism if no agree- <br />ment reached? <br /> <br />I6. <br /> <br />I 8. <br /> <br />I9'. <br /> <br />I10. <br /> <br />I 11. <br />I 12. <br /> <br />I13. <br /> <br />Require MPCA to develop rules for end use of landfills. <br /> <br />Waste facility, should-.pay-for direct costs-.(fire~_water,_sewer,_buffer design). <br /> <br />Waste facility or county should assume responsibility for access road maintenance and <br />upgrading. ~ : <br /> <br />Waste facility or county should provide sufficient buffer area and/or screening needed <br />by the city or township. <br /> <br />Waste facility should purchase sufficient land to shield adjacent properties from <br />property value impacts and nuisances. County and cit~ should study impact on property <br />value after site selection. . <br /> <br />Landfill end use plan should be prepared before doing EIS and should be approved by <br />city or township. <br /> <br />City or township should be co~ing involved in the permitting process (ldcal oversight <br />committee). <br /> <br />The Metropolitan Council should provide sample ordinances for local regulation of <br />solid waste facilities. <br /> <br /> <br />
