Water Enterprise Fund <br /> <br />Mr. Goodrich stated that this completes the review of changes to Part I <br />(Policy) and Part II is amendments to the City Subdivision Code and that <br />this relates basically to new subdivisions. The subdivision code is how <br />a developer or any landowner is able to subdivide property and the processes <br />he must go through to do so. The purpose of this ordinance is to amend <br />170.03 of City Code. <br /> <br />1.. 179.039B (page 1) <br /> <br />Item e. reads Storm drainage <br />Item f. should read Municipal potable water <br /> <br />2. 170.039D (page 4) <br /> <br />Item 4. Originally read: Upon transfer of title by contract for deed or <br /> warranty deed with respect to any of the lots .... <br /> <br />Now reads: At the time of the application for a certificate <br />of occupancy or, at the time of transfer of title by contract <br />for deed or warranty deed with respect to any of the lots in,the <br />subdivision, the applicant or seller shall pay to the City . <br /> <br />Mr. Goodrich stated that this wording makes payment due when house is <br />built and the individual is reay to move in versus when lot is sold or <br />when lot is sold on a contract for deed. <br /> <br />Item 5. The wording "application for a certificate of occupancy" is <br /> utilized in this paragraph also. <br /> <br />Councilmember Sorteberg stated that he is not so sure that this is the <br />way to go and what happens to the developer's letter of credit? <br /> <br />City Attorney Goodrich replied that letter of credit continues until <br />assessments are paid off. <br /> <br />C/April 26, 1983 <br /> Page 15 of 30 <br /> <br /> <br />
