GOODRICH, CITY A]q-ORNEY <br /> <br />TO: <br /> <br />FROM: <br /> <br />RE: <br /> <br />DATE: <br /> <br />Ramsey City Council <br /> <br />City Attorney William Goodrich <br /> <br />M & L Liquor License Location Transfer <br /> <br />June 6, 1983 <br /> <br />At the Council's May 31, 1983 meeting, you requested me to advise <br />you as to the procedures necessary for a license to transfer <br />locations. The City's 'off-sale' liquor license Chapter 170.09, <br />Section 170.O98 provides as follows: <br /> <br />No transfer of a license shall be permitted from place <br />to place or person to person without complying with the <br />requirements of an original application, and each such <br />transfer shall require the approval of the City Council <br />and the Liquor Control Commissioner. <br /> <br />Therefore, it is clear that a new application will be required. <br />As a part of the new application, the applicant will need to <br />advise you of the proposed new location and the type of facility <br />he proposes. I recall that one of the reasons the City chose <br />pr.ivate off-sale as opposed to municipal off-sale was to encourage <br />an investment into the City and increase the property tax base. <br />Therefore, you may want to compare the old M & L Liquor facility <br />with the proposed new location on a market value basis. Of course <br />the old building will still be left, which presumably will continue <br />to create market value for the City. <br /> <br />I can find nothing in Chapter 173.09 which would require the City <br />to consider other persons for this license even though a location <br />transfer and new application is required. However, in the future, <br />should a licenseedesire to substantially change its location, then <br />the Council may want to consider other licensees. <br /> <br />WKG:pjc <br /> <br /> <br />
