GOODRICH, CITY A]q-ORNEY TO: FROM: RE: DATE: Ramsey City Council City Attorney William Goodrich M & L Liquor License Location Transfer June 6, 1983 At the Council's May 31, 1983 meeting, you requested me to advise you as to the procedures necessary for a license to transfer locations. The City's 'off-sale' liquor license Chapter 170.09, Section 170.O98 provides as follows: No transfer of a license shall be permitted from place to place or person to person without complying with the requirements of an original application, and each such transfer shall require the approval of the City Council and the Liquor Control Commissioner. Therefore, it is clear that a new application will be required. As a part of the new application, the applicant will need to advise you of the proposed new location and the type of facility he proposes. I recall that one of the reasons the City chose pr.ivate off-sale as opposed to municipal off-sale was to encourage an investment into the City and increase the property tax base. Therefore, you may want to compare the old M & L Liquor facility with the proposed new location on a market value basis. Of course the old building will still be left, which presumably will continue to create market value for the City. I can find nothing in Chapter 173.09 which would require the City to consider other persons for this license even though a location transfer and new application is required. However, in the future, should a licenseedesire to substantially change its location, then the Council may want to consider other licensees. WKG:pjc
