Date of Accident: 351-L-737010 Marilyn Gallagher 3-19-85 We acknowledge receipt of the Summons and Complaint in the matter of Marilyn Gallagher, Plaintiff, vs. City of Ramsey, et al, Defendants, instituted in District Court, Anoka County, State of Minnesota and arising out of an accident alleged to have occurred on 5-19-85. At this time, we call your attention to the fact that the Plaintiff seeks damages in excess of Fifty thousand Dollars ($50,000.00). Even though your insurance policy affords coverage in the amount of Five hundred thousand Dollars ($500,- 000.00) for injury liability or death, including loss of services, of one person, and in the same amount for injury or death, including loss of services for, more than one person, the amount of damages demanded may exceed your policy coverage. This is the total limit of liability, regardless of the number of defendants insured under the policy. You should also note that there is a claim for punitive damages in the allegations. Your policy IST 8776170-61876 does not provide protection for punitive or exemplary damages. Punitive Damages do not meet the definitions of bodily injury, personal injury liability or property damage under your policy. We wish to inform you that it is your right and privilege to engage counsel, at your own expense, to protect your uninsur- ed interest in this litigation.
