ROBERT MULLER: Mr. Robert Muller is requesting a variance to place a dwelling 20 feet from a street right-of-way where City Ordinance requires that setback to be 40 feet. Due to the existing elevation and flood plains, it would be almost impossible to develop this property without the variance. This property was assessed as a buildable site at the time the street improvements were installed. The following items are included as enclosure (D4-a) for your consideration: a) Applicant's application b) Public hearing notice c) Certificate of survey of the property d) Area location map e) List of properties notified f) Proposed findings of fact g) Letter to Mr. Robert Muller Council Action: Your action in this matter should be to approve/ amend/deny the findings of fact as well as approve/disapprove of the request. The following proposed motions are hereby submitted for your consideration: Motion by'~/~'P and seconded by~-~ to adopt/ amend/deny ~he findings of fact for Mr. Robert Muller's request to construct a dwelling with a setback of 20 feet from the street right-of-way on the side of his property.
