The city council, at its discretion, may extend for six (6) months the period for filing of the final development plan.' 1. The zoning ~fficer shall send a reproducible print and one (]) other print to the chairman of the city planning comm5ssion. A publ.~-c,.-hearing.on an appli'i:ation for final approval of the plan or part thereof:~'sha'!l not'b~;'"~t&quired, provided that the plan is in substantial compliance with th_e plan given preliminary approval. 3. In the event the plan, as submitted for final approval, is not in snbstantia] compliance with the preliminary plan, the city' council shall notify the applicant within forty-five (45) days of the date of application setting forth the ways in which the plan is not in substantial compliance. The applicant may treat snch notification as denial of final approval; or The applicant may refile his plan so that it does substantially comply with the preliminary plan; or The applicant may file a written request with the city council that it hold a public hearing on his request for final approval. Any such hearing shall be held within thirty (30) days after the request for such a hearing. Within forty-five (45) days of such hearing, the city council shall either grant final, approval or deny final approval to the plan. 4. In the event a plan is given final approval and the applicant shall abandon said plan, or in the event the applicant sba].], fail to begin construction of the planned unit development within twelve (12) months after the final approval has been granted, final approval shall terminate unless such time period is extended by tile city counc.il, GI~EICJ~ REQUI RI~,IENTS In a p]_anned unit development, the following regulations should be considc, red prior to the submission of a preliminary development plan.
