Commissioner Zimmerman, regarding Item #5, inquired as to why it was even necessary for the City to get involved and why don't the developers of the north have just give the land for an additional 9 holes of golf to Mr. Bulen directly. I I i I I I Mr. Dom explained that in order for the developer's of the north have to acquire a tax deduction the land must be donated to a public body which Mr. Bulen is not. This mechanical feature is permissible under internal revenue code. Commission consensus is that access to the property would have to be reviewed by State Highway Department. Chairman Peterson suggested returning the park land proposed to be used to the donator, Mr. Tom Anderson, who is also one of the developers of this proposed PUD and collecting a park fee from Mr. Anderson. Mr. Dorn noted that by the City retaining title and leasing the property to a private owner, the land would return to the tax roles. CommisSion agreed that including this park~land in the golf course would be the best use of thi~"property. Mr. Berg stated tha~~ this con~eP~ ~hould be reviewed with DNR. I I I I I Commissioner Deemer suggested that the two parcels the developers are requesting being zoned for multiple dwellings just be designated outlots, that it might be misconstrued by the public that the City intends to brin~ sewer and water this far north. City Administrator Schnelle suggested advance covenance for residential property owners in the PUD. Mr. Dorn stated that plans are to give the residential property owners 5 years free golfing privileges at the course. Mr. Berg Suggested that this PUD concept be presented to Council before proceeding to the preliminary plat approval stage. Motion by Commissioner Deemer and seconded by Commissioner Schneider to recommend Ramsey City Council approve the conceptual plan for a PUD, as presented providing City ordinance are met as determined by the City Engineer and City Attorney, that there be one direct access to the property from State Hwy. ~47, that the Park Board review utilization of existing park land and that the two parcels proposed for multiple dwellings be designated as Outlots A and B. Motion carried. Voting Yes: Chairman Peterson, Commissioners Zimmerman, Deemer, Isakson, Schneider and LaDue. Voting No: None. Chairman Peterson noted a special meeting of P&Z to be held Tuesday, July 19, 1983 at 7:30 p.m. regarding Capital Improvement Program.
