No work will be commenced until a waiver of trespass is signed by both <br /> parties. <br /> <br />2. Work prior to September 1, 1982 will be limited to the storm sewer <br /> construction which will bd constructed within the easement limits. <br /> <br />3. No tree will be removed outside of the 10 feet of permanent easement <br /> over each lot. <br /> <br />4. Rip rap along the river bank shall be sized and placed to match the <br /> existing rip rap. No concrete shall be used. <br /> <br />I <br />I <br /> <br />The easement shall be revised to state that use will be limited to <br />drainage purposes only and the landowners will be allowed to place <br />trees within five feet of'the lot. However, the City will maintain <br />the right to enter upon the entire 20 feet of permanent easement and <br />will not be liable for any damage to trees. <br /> <br />I <br />i <br /> <br />Upon written consent from the landowners, the City agrees to fill Lots <br />13 and 14 of Bower's Mississippi Acres to one foot above the 100 year <br />flood elevation starting at approximately the building setback line <br />and continuing for a distance of approximately 150 feet towards the river. <br /> <br />civil · municipal · planning · soils · land surveying <br /> <br /> <br />
