It is necessary ~ only that it be in written form. _ If an individual, group or organization Ibelieves that there has been a violation of the public participation requirements which · have been described in this booklet, a written ~ explanation detailin§ the nature of the alleged violation and any supporting docu- imentation should be sent to: Public Participation/Compliance Office of Revenue Sharing U.S. Department of the Treasury 2401 E Street, N.W. Washington, D.C. 20226 k. · To assist the Office of Revenue Sharing in handling a complaint, the following informa- ~ tion should be provided by the individual, · group or organization (the complainant) making the allegation: I 1. Name, address, and phone number of complainant I 2. Other persons havin~l knowledge of the " alleged violation who may be contacted · (The name of the complainant is not ~ made known to the recipient govern- ment without the permission of the i complainant.) " 3 Name and address of the offending · government and the name of its Chief ~ Executive Officer (mayor, city manager, county executive, chair of · county board, governor, tribal chief or ~ village president) 4. Specific way or ways in which the public participation requirements are being or have been violated by the governmenl 5. Newspaper articles, copies of public notices, correspondence, minutes of meetings, and as much other informa- tion which can be obtained to support the allegation Disagreement with a government's planned use or actual use of revenue sharing money does not constitute a violation. Action .by the Office of Revenue Sharing After Receipt Of Complaint 1. The complaint will be acknowledged and examined. 2. If the examination of the complaint indicates a possible violation of the law, the Office of Revenue Sharing will: · notify the Chief Executive Officer of the receipt of the complaint. · conduct an investigation into the alleged violation. The affected government will have an opportunity to answer the compliant. If the answer does not support a claim~of '- .' compIiance, the government will be_~i_!yen the opportunity to voluntarily correct the situation. _~-~ ~ :.~-::-.-,: .~--~ If the affected government`: d'Oes-:"i~Ot undertake the corrective actions v°'lUn tarily, the Office of Revenue Sharing will begin formal legal procedures. Upon conclusion of le§al actions, a government will be given adequate time to correct the deficiencies. For any government failing to take such corrective actions, the Office of Revenue Sharing will: · fully recover general revenue sharing money which has been spent illegally. · withhold all future general revenue sharing money until satisfied that full compliance with the public participa- tion requirements has been achieved.
