It is necessary <br /> ~ only that it be in written form. <br /> <br /> _ If an individual, group or organization <br /> Ibelieves that there has been a violation of the <br /> public participation requirements which <br /> · have been described in this booklet, a written <br /> ~ explanation detailin§ the nature of the <br /> alleged violation and any supporting docu- <br /> <br /> imentation should be sent to: <br /> <br /> Public Participation/Compliance <br /> Office of Revenue Sharing <br /> U.S. Department of the Treasury <br /> 2401 E Street, N.W. <br /> Washington, D.C. 20226 <br /> <br />k. · To assist the Office of Revenue Sharing in <br /> handling a complaint, the following informa- <br /> ~ tion should be provided by the individual, <br /> · group or organization (the complainant) <br /> making the allegation: <br /> I 1. Name, address, and phone number of <br /> complainant <br /> I 2. Other persons havin~l knowledge of the <br /> " alleged violation who may be contacted <br /> · (The name of the complainant is not <br /> ~ made known to the recipient govern- <br /> ment without the permission of the <br /> i complainant.) <br /> " 3 Name and address of the offending <br /> · government and the name of its Chief <br /> ~ Executive Officer (mayor, city <br /> manager, county executive, chair of <br /> · county board, governor, tribal chief or <br /> ~ village president) <br /> <br /> 4. Specific way or ways in which the public <br /> participation requirements are being or <br /> have been violated by the governmenl <br /> <br /> 5. Newspaper articles, copies of public <br /> notices, correspondence, minutes of <br /> meetings, and as much other informa- <br /> tion which can be obtained to support <br /> the allegation <br /> <br />Disagreement with a government's planned <br />use or actual use of revenue sharing money <br />does not constitute a violation. <br /> <br />Action .by the Office of Revenue Sharing <br />After Receipt Of Complaint <br /> <br />1. The complaint will be acknowledged and <br /> examined. <br /> <br />2. If the examination of the complaint <br /> indicates a possible violation of the law, <br /> the Office of Revenue Sharing will: <br /> <br /> · notify the Chief Executive Officer of <br /> the receipt of the complaint. <br /> · conduct an investigation into the <br /> alleged violation. <br /> The affected government will have an <br /> opportunity to answer the compliant. If <br /> the answer does not support a claim~of '- .' <br /> compIiance, the government will be_~i_!yen <br /> the opportunity to voluntarily correct the <br /> situation. _~-~ ~ :.~-::-.-,: .~--~ <br /> If the affected government`: d'Oes-:"i~Ot <br /> undertake the corrective actions v°'lUn <br /> tarily, the Office of Revenue Sharing will <br /> begin formal legal procedures. Upon <br /> conclusion of le§al actions, a government <br /> will be given adequate time to correct the <br /> deficiencies. For any government failing <br /> to take such corrective actions, the Office <br /> of Revenue Sharing will: <br /> <br /> · fully recover general revenue sharing <br /> money which has been spent illegally. <br /> · withhold all future general revenue <br /> sharing money until satisfied that full <br /> compliance with the public participa- <br /> tion requirements has been achieved. <br /> <br />VI.
