I <br />I <br />I <br />I <br />I <br />,I <br /> <br />Councflmember Cox introduced the following Resolution and moved for its adoption: <br /> <br /> RESOLUTION 82-120 <br />City of Ramsey <br />Anoka County, Minnesota <br /> <br /> ~H~REAS, on August 24, 1982, the Anoka County Board adopted a resolution in <br />opposition to including the present landfill site in proposed Landfill Site P; and <br /> <br /> WHEREAS, this action by the Anoka County Board fails to recognize the potential <br />adverse health factors relating to the existing landfill site; and <br /> <br /> WHEREAS, the Metropo].itan Council Staff has advised the City to seek special <br />legislation from the 1983 State Legislature in order for the State and/or County to <br />assume liability for the existing site; and <br /> <br /> ~EREAS, City Ramsey predecessor, Ramsey Township, no legal <br /> the <br /> of <br /> and <br /> its <br /> had <br /> right to oppose the existing landfill and/or regulate the site's operation according <br /> to an Attorney General's opinion; and <br /> <br /> WHEREAS, Anoka County from the landfill's inception did have the right to <br /> regulate the site and its operation; and <br /> <br />~{EREAS, the Metropolitan Council Staff has advised the City that the <br />.Metropolitan Council'is working on legislation relating to landfill ~iability and <br /> economic burdens on local communities in which they exist. <br /> <br />! <br />I <br />I <br />I <br />I <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> 1. That City Staff is directed to work in conjunction with the Metropolitan <br />Council Staff in the preparation of proposed special legislation relating to the <br />existing and future liability problems of the existing landfill site. This <br />legislation should direct that either the State or Anoka County accept the full <br />burden of the liability on the existing landfill site. <br /> <br /> 2. That Legislation should also be offered which explicitly permits the City to <br />charge and receive a per ton drop charge on all refuse which goes into the existing <br />site and/or the proposed Site P. <br /> <br /> 3. ~hat the Legislation should also be of a nature that will compensate the <br />City for its ~onomic loss resulting from lost property taxes, inability to fully <br />assess the landfill site for utilities and the potential expense related to <br />relocation of City wells and other high capacity wells. <br /> <br /> The motion for the adoption of the foregoing resolution was duly seconded by <br />Councilmember Van Wagner and upon vote being taken thereon, the following voted in <br />favor thereof: <br /> <br /> Councilmember Cox <br />Councilmember Van Wagner <br />Councilmember Sorteberg <br /> Councilmember Reimann <br /> <br /> <br />
