If theY had not negotiated the settlement, <br />we may have been in worse shape. This case points out why this <br />workers' compensation law has to be cleaned'up. <br /> <br />Insurance Service Center's letter dated September 10, 1982. ~ <br />In his'.letter, Mr. Newell Chester answers my question as to if it <br />would be better for Ramsey to pay the Buchite loss. He points out <br />that it is better for us to let %he Home Insurance Company cover <br />the loss. He does make suggestions how the City can better protect <br />themselves in the future. The contents of this letter will be <br />going to the Personnel Committee regarding physicals, etc. Then <br />it will come back to the Council for final action. <br /> <br />Council Action: Your action will be to note that you have reviewed <br />the letters from the Home Insurance Company and Insurance Service <br />Center. Any other action will have to be dictated by Council. <br /> <br />REQUEST FOR AN ACCESSORY BUILDING; CASE OF MR. KENNETH MILLER: <br /> <br />Mr. Kenneth Miller of 13914 Sunfish Lake Blvd. NW has again requested con- <br />sideration for an accessory building at his residence. Mr. Miller's initial <br />request was for a structure 24' x 26' which you approved. However, when <br />Mr. Miller came in to apply for his permit, he wanted to build a larger <br /> g than what the Council had approved. He was informed by the <br />Building Official that this would require a Board of Adjustment variance <br />and would have to go back to Council. He was also informed of the $90.00 <br />non-refundable fee. He does not think this is fair and therefore wishes <br />to address Council on this matter. <br /> <br /> Ordinance for Board of Adjustment is quite' restrictive. However, if <br /> · Miller desires to build a commercial building, then the Building Code <br />becomes very restrictive. <br /> <br />If you feel that Mr. Miller should have a larger building, then we would <br />recommend you advise Mr. Miller to invest the $90.00 for a Board of Adjust- <br />ment fee as that would cost substantially less than a commercial building <br />would cost. '. <br /> <br />DRAINAGE PROBLEM REGARDING JASPAR STREET AND 162ND LANE; CASE OF MR. JOE <br /> <br />MCCARTY: <br /> <br />This case has been before the Council several times and the last time the <br />City stated that if Mr. McCarty bought the culvert, the City would install <br />it. There would be a certain amount of landscaping needed to provide ade- <br />quate drainage which the City would have to do. <br /> <br />In discussing this with Street Superintendent Mevissen again, he stated <br />that five years ago prior to that street improvement, Fir. McCarty wanted <br />the City to install a culvert. <br /> <br />..City Staff is willing to execute any policy Council decides on in this <br />case, however, if the City is going to purchase this culvert, keep in <br />mind we have others out there who would want the same service. <br /> <br /> <br />
