I I I I I I I I PROPOSED FINDINGS OF FACT FOR ERWIN TOLKI~EN, 14503 BOWERS DRIVE NW 1) The City Council, at their meeting of April 27, 1982, adopted Resolution #82-49 declaring adequacy of petition and ordering preparation of a report for Street Improvement Project #82-6 for Bower~ Mississippi Acres First ~-Idition. 2) The City Council, at their meeting of April 27, 1982, adopted Resol~tion #82-50 receiving the report and calling for a public hearing on Project #82-6 (Bower's Mississippi Acres First Addition}. Said public bearing was ordered for 7:00 p.m., May 17, 1982. 3) A notice of said public hearing was placed in the City's official newspaper according to law and individual notices were mailed to all affected residr~nts. 4} The pubilc hearing was held bn May 17, 1982 and input was received from numerous residents. However, Mr. Tolkinen's name did not appear in the minutes as having any input. 5) On May ]7, 1982, the City Council adopted Resolution #82-71 ordering Street Improvement Project #82-6 for Bower's Mississippi Acres First Addition. 6) On June 1, 1982, the City Council adopted Resolution #82-86 approving plans and specifications, ordering bids for Street Improvement Project #82-6 and setting the bid opening for July 12, 1982 at 11:00 a.m. 7) On July 12, 1982, the City Council adopted Resolution #82-98 receiving and awarding bids for Street Improvement Project #82-6 to Buffalo Bituminous. 8) On September 29, 1982, the City Council held an assessment hearing and adopted the assessment rolls for Project #82-6. 9) The assessment policy for all projects was to divide the total cost by the total number of buildable parcels of land. 10) In this area there were severai owners that were assessed more than one unit. 11) Using the City's criteria for determining a parcei's suitability for building, there were parcels that were not assessed. 12) The City of Ramsey's criteria for determining a parcel's buildability are: a) Adequate areas for the placement of and proper construction of an on-site septic system. b) Positive parcel drainage to eliminate flooding potentials under all conditions. c) Adequate area to place a structure and meet the setback requirement of the Ordinance. ]3) D~e to the parcel configuration, Mr. Tolkinen, at the assessment hearing, requested this assessment be deleted.
