Because of this delay by North Central Public Uti~ and previo~ eomm~'~ments by UD Contracting, Inc., was foxed to move to other projects until No~th Central Public Ut~es had completed its work. When North Central Publ~ Utilities ~ad completed its ~rk UD Contra~ting, Inc., moved its equipment back to the project and once again proceeded at a ~apid pace. Tn continued, weather pe~g, t~ough the subg~ade, underground ~es and Clas~ 5 Base. The Class 5 Base ~us placed and tole~anced and th~ bitu~ous wa~ s~eduled three t~mes. Each time ~ ~ancel~ed o~ plans fol bituminou~ and that b~x~gs us to the pr~ent time. I I I i ! If we do extend beyond t~e ~ completion d~e UD Comtract~ng, Inc.~ ~ ~equ~t add~onal time for completion based on the above mentioned reasons. I mu~t poZ~t out that UD Connoting, Inc., do~s not p~an to arbit~ accept ~quidated damages and ~ in ever~ and any way aggr~sively seek to ~ave them dism~sed.
