I <br />! <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br />I <br />I <br />! <br /> <br />It was the general consensus of the Committee that the public improvements <br />ordinance should be a separate ordinance and not included as a part of the <br />Subdivision Code. The public improvement ordinance will be included in the <br />Assessment Chapter. <br /> <br />Mr. Berg suggested that the ordinance begin with a general section addressing <br />where, how, when and who. <br /> <br />Mr. Goodrich stated that the Committee cannot write the ordinance, but rather <br />set the policy, and he in turn will write the ordinance and submit it to the <br />Committee for their review and approval. <br /> <br />After much discussion, the following format for the ordinance was arrived at: <br />POLICIES: LATERAL <br /> <br />A. Extension <br /> <br />1. Existing Subdivisions <br /> <br /> a. Area being assessed for trunk. <br /> b. All zoning districts treated same. <br /> c. Health hazard as determined by City Council. <br /> d. Chapter 429 proceeding by City Council. <br /> <br />2. Unsubdivided Land <br /> <br /> a. When area being assessed for trunk. <br /> <br /> b. Land platted. <br /> <br /> c. Petition and agree to pay on interim for trunk to be extended to <br /> your area. <br /> <br />3. Public Property <br /> <br /> a. Trunk available. <br /> b. Health hazard. <br /> c. Chapter 429 proceeding by City Council. <br /> <br />4. Unbuildable Lands <br /> Definition: a) DNR classified wetlands - no exchange. <br /> b) Floodway <br /> c) Public and/or private street and/or utility easements. <br /> d) Drainage ponds defined by public easements. <br /> <br /> Policy for Extension: Never <br /> <br />Ad Hoc/Public Improvements <br /> Page 2 of 4 <br /> October 18, 1982 <br /> <br /> <br />
