I <br /> I <br /> I <br /> I <br /> I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> I <br /> I <br /> I <br /> <br />15) <br /> <br />16) <br /> <br />~8) <br /> <br />~9) <br /> <br />2o) <br /> <br />2~) <br /> <br />22) <br /> <br />That Mr. Peltzer again at a later point in the meeting, addressed the <br />City Council and they agreed to allow Mr. Peltzer an extension of time <br />until 5:00 P.M., Monday, November 29, 1982, to deposit with the City <br />his $300 escrow and apply for a variance at a cost of $50.00. <br /> <br />That the $50.00 fee as requested was later improper as a variance which <br />deals with structure must be granted by the Board of Adjustment and <br />further that said fee for a Board of Adjustment variance has been es- <br />tablished at $90.00. <br /> <br />That on November 29, 1982, Mr. Pel'tzer deposited with the City a cashiers <br />check in t~e amount of $300. <br /> <br />That on December 1, 1982, Mr. Pettzer applied for a Board of Adjustment <br />variance to keep the mobile home on his property until June 1, 1982 and <br />paid the proper fee. <br /> <br />That the Board of Adjustment variance is required because it deals with <br />.structure. <br /> <br />That Mr. Peltzers mobile home does not comply with the requirements of <br />tt~e mobile home ordinance. <br /> <br />That a mobile home was placed and is still in use at Greenberg's on <br />Highway #10. <br /> <br />That sa~d mobile home was authorized by a conditional use permit to aid <br />in security of the automobile lot. <br /> <br />23) That the variance criteria are as follows: <br /> <br />a) <br /> <br />That there are exceptional, unique, or extraordinary circum- <br />stances or conditions applying to the property in question <br />as to the intended use of the property that do not apply <br />generally to other properties in the same zoning district <br />inasmuch as Mr. Peltzer has necessary farm buildings and farm <br />animals at this residence. <br /> <br />b) <br /> <br />That such a variance is necessary for the preservation and en- <br />joyment of a substantial propertY right similar to that possessed <br />by other properties in the City. ' ' <br /> <br />c) <br /> <br />That the authorizing of such variance will not be of substantial <br />detriment to adjacent property and will not materially impair <br />the intent and purpose of this ordinance or the public interest; <br /> <br />d) <br /> <br />That the condition or situation of the specific piece of prop- <br />erty, or the intended use of said property, for which the <br />variance is sought, is not of so general or recurrent a nature <br />as to make reasonably practicable the formulation of a general <br />regulation for such conditions or situation; <br /> <br />~) <br /> <br />That the variance observes the spirit and intent of this ordi- <br />nance, produces substantial justice and is not contrary to the <br />public interest. <br /> <br /> <br />
