I <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Case #2: Group W Cable Of Quad Cities, Inc.'s Request For A Conditional Use <br /> Permit' <br /> <br />Chairman Peterson read the proposed Findings of Fact as submitted by City <br />Staff, to the Commission and audience present. <br /> <br />The Commission then discussed the Findings of Fact point by point. The <br />matter of safety hazard was discussed and it was suggested that a fence <br />surrounding the accessory building and tower could be a condition of the <br />conditional use permit agreement if necessary. <br /> <br />Commissioner Schneider co~nented that another alternative to locating"in a <br />residential area would be to 9et approval from Metro Council to utilize <br />only a small portion of the 40 acre parcel across the street from Rolling <br />Green for a Cable tower. Mr. Berg suggested that the 40 acre parcel could <br />be split into 4 - 2½ acre parcels and one 30 acre outlot, which would <br />accomodate the Metro Council and Group W, but the owner of the 40 acre <br />parcel must be receptive to this idea. Commissioner Schneider stated that <br />she doesn't feel that a thorough search for the most suitable property <br />for all concerned has been performed. <br /> <br />Mr. Fults commented that the tower is only 2' square, but if this proposed <br />site is not approved, he and Group W will search for another suitable site. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Isakson to accept <br />the Findings of Fact as amended: <br /> <br /> Item 4d - The the subject property is approximately 3 acres in size. <br /> <br />Item 4i - Properly maintained, the microwave tower and accessory building <br /> may affect the lifestyle of the neighboring residents in a <br /> residential setting. Further, it could affect the enjoyment <br /> or substantially impair the use of any adjoining property. <br /> <br />Item 4j - The proposed tower could result in injury to tresspassers on <br /> the property. <br /> <br />Item 5c - Correction to the first words of lines two and three: Change <br /> to nor. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Isakson, <br />Deemer and Zimmerman. Voting No~ Commissioners Schneider and LaDue. <br /> <br />Commissioners Schneider and LaDue stated that they based their vote on the <br />fact that they feel Item 5c under Criteria for Approval is too subjective. <br /> <br />Motion by Commissioner Isakson, based.on the Findings of Fact, to recommend <br />City Council approve conditional use permit for the purpose of a T.V. tower <br />and accessory building to be located at Outlot A of Rolling Green, and <br />further that the City enter into an agreement with Group W Quad Cities, Inc. <br />as outlined in the proposed condi'tional use permit. <br /> <br />Commissioner Deemer seconds the motion for further discussion: Commissioner <br />Deemer suggested that Item #6 of the proposed Conditional Use Permit <br />Agreement be designated as Item #7 and the following added as Item #6: <br /> <br />P'& Z/December 7, 1982 <br /> Page 3 of 4 <br /> <br /> <br />
