I
I
I

Memo to Ramsey City Council
June 17, 1982
Page Two

I spoke to Paul Rudd who advised me that the County, to his
knowledge, has never condemned the access rights to any county
highway.

I do have some research to complete, however, at the time of
writing this memo it appears to me that in order to take away
the access rights, the landowner will have to be paid his
damages which damages would appear to be minimal. For your
information, I have spoken to the Attorney General's Office and
the County Attorney's Office in preparation of this memo.

The Council may want to request the County to bring a
condemnation action regarding this matter. Another alternative
would be for the City to bring a District Court action seeking
to enforce our zoning ordinance. You should be advised that
such an action could be turned into an inverse condemnation
action by the Lees. By the time of your meeting on June 22,
1982, I will have completed my research on this subject and will
advise you accordingly.

wkg/cmh
