BE IT ENACTED BY T54]E LEGISLATURE OF ThE STATE OF MIIqNESOTA: Section 1. Minnesota Statutes 1980, Section 461.12, is amended to read: 461.12 [FFONICIPAL CIGARETTE LICENSE.] The tom board or governing body of each tom and home r~le charter and statutory city e~ amy e~ase? mayr af~e~ 8am~a~y ~T ~94~T license and reg~late the sale at retail of cigarettes, cigarette paper, or cigarette wrappers and fix the license fee town or city may charge a uniform annual fee for all sellers or 16 different annual fees for different classes of sellers. It may 17 provide for thm punis~uuent of any violation of m~eh t-he 18 regulations, and make e~e~ other provisions for the reg~alation 19 of the sale of cigarettes within its jurisdiction as are 20 permitted by law. %~he county board may make like provisions for 21 licensing and reg~llating t-he sale of cigarettes in unorganized 22 territory. The provisions of this section shall not apply to 23 'the licensing of sale of cigarettes in cars of common carriers.
