c. Changing from Industrial to Rural Industrial

Jack Menkveld - 2207 7th Avenue - Anoka - My property was rezoned from
agricultural to industrial in 1979. At that time, it was outside the
unsewered area and nothing has changed since then. Why are you
changing the zoning now?

Attorney Goodrich - We are not making that area any more unique than
it already is, the parcel just happens to fall outside the sewered area.

Councilmember Cox - What is Jack Menkveld required to do now that he
wasn't required to do before rezoning, if he wanted to put in a business.

Mayor Gamec - Basically, prove that he has an adequate sewer system.

Attorney Goodrich - The rezoning does eliminate any use that will
discharge process waste water.

Councilmember Cox - I am concerned that we are hindering potential
industrial growth in the City by putting too many stipulations in the
way of the developer.

Mr. Schnelle - If the developer can prove he has an adequate sewer
system, he can get a variance to develop.

Jack Menkveld - I don't know of many businesses that don't require
some degree of use of process water. Even Ralph's Country Meats
has process waste water.

Council recessed at 9:00 P.M.

Mayor Gamec called the special Council Meeting back to order at 9:19 P.M.

Attorney Goodrich recommended adding item #7 to Findings of Fact
as follows:

That the discharge of process waste water may cause ground/
water pollution and therefore necessitate municipal
sewer service.

Mayor Gamec polled Council for their opinions on proposed ordinance
to change Industrial to Rural Industrial:

Councilmember Sorteber§ - I don't feel we need more water restrictions
on it because of it's closeness to urban area and don't foresee
any major problems and that we should leave it the way it is.

Councilmember Reimann - I agree with Councilmember Sorteberg.

Councilmember Cox - I agree with Councilmember Sorteberg. Closeness
of railroad tracks and being adjacent to the urban service area,
I feel, are reasons enough to leave it as is.

Councilmember Van Wagner - I am in favorof rezoning. There is nothing
wrong with being cautious and this area can be reviewed periodically
as sewer goes in.

Sp C/February 9, 1982
Page 4
