F. Change area designated Residential to Rural Open Space; <br /> <br />Motion by Chairman Peterson and seconded by Commissioner Deemer to adopt the <br />Findings of Fact. <br /> <br /> Findings of Fact: .i <br /> <br /> 1. Title Change - Rural to Recreational <br /> <br />INCORPORATE INTO FINDINGS OF FACT, P & Z FINDINGS OF FACT FROM OCTOBER 6, 1981: <br /> <br />That the Applicant has properly applied for rezoning of a parcel of prop- <br />erty from R-i, Residential, to B-l, Business zoning for a specific portion <br />of said property with the remainder to be zoned to a classification apt <br />to be established. Staff recommendation for said zoning is recreational <br />open space. <br /> <br />That the property is known as Plat 89211, Parcel 9000 and is located at <br />the southeast corner of the intersections of State Trunk Highway #47 and <br />167th Avenue NW. <br /> <br />That the Applicant appeared before the Planning and Zoning Commission at <br />their regular meeting of October 6, 1981 for a public hearing and presented <br />his request. <br /> <br />5. That said public hearing was properly advertised and a copy of said public <br /> hearing is hereby incorporated as a part of these findings. <br /> <br />6. That the Applicant's property is adjoined on all sides by R-1 zoning, but <br /> there is a B-1 zoning just to the northwest of his property. <br /> <br />7. That access to the property would have to be provided from State Trunk <br /> Highway #47. <br /> <br />That no rezoning requests have been submitted for said property; however, <br />rezoning requests for other parcels in the immediate vicinity have been <br />denied. <br /> <br />9. That neither the existing comprehensive plan nor the proposed comprehensive <br /> propose any rezoning of this property. <br /> <br />10o That said application may be subject to Metropolitan Council review. <br /> <br />11. Legal description of area be rezoned B-1. <br /> <br />12. Proposed use will decrease the overall density of the area. <br /> <br />13. Rezoning to B-i, or any portion thereof, will reduce the control the City <br /> has over that property. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Deemer, Dunn, <br />Zimmerman and Schneider. Voting No: None. <br /> <br />Motion by Commissioner Zimmerman and seconded by Commissioner Deemer, based on <br />the Findings of Fact, to recommend to City Council approval of this proposed area <br />to be rezoned Recreational. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Deemer, Dunn, <br />Zimmerman and Schneider. Voting No: None. <br /> <br />P & Z/February 2, 1982 <br /> Page 10 <br /> <br /> <br />
