I I I I GIL~NT /'~'.]}..i;t::'~;'] bLTWi~LN 'FH!: ;-U;7:-< ~PCLITAN COUNCIL AND TIlE CITY OF RAMSEY ~{EREAS, the Metropolitan Council, hereinafter referred to as the "Council," and the Ci~V of R~nJ]iS~C_y , hereinafter referred to as the "Grantee," have previously ~ntered into a Grant agreement for a local planning assistance grant, Metropolitan Council Contract- No. 78100 , dated FebruaKy ]q , 1979 , and amended on Mav 28 lq70 and [an~,ar¥ 28 i ~ 3i]4_ and WHEREAS,the Council has awarded $ 6,~0! in 1980-81 grant funds to the Grantee from funds appropriated by Minnesota Laws 1979, Chapter 333, Section 16, Subdivision 4, for the preparation of its comprehensive plan required by the Metropolitan Land Planning Act; and WHEREAS, the Grantee has made a timely submission of its comprehensive plan to the Council. m m m m I N OW THEREFORE, the parties hereto agree that the above-referenced agreement shall be amended in the following particulars: I. oaragraph lA is amended to read as follows: "The Council shall pay to the Grantee, in accordance with the schedule set forth below, a total grant amount of $_ [~;0~ . Grant funds shall be made available to the Grantee as follows: $____Tj.~____in 1976-77 and 1978-79 grant funds paid previously upon execution of the original agreement and subsequent interim amendments; $ 8~ in remaining 1976-77 and 1978-79 grant funds upon satisfactory evaluation by the Council of the funded portion completion reports submitted by the Grantee pursuant to paragraph 4B of this agreement; $_ 6~__~.~:~~,-~--~.~in 1980-81 grant funds are to 5% paid in the following manner: / $___3~3_%) - upon determination by the Council that the Grantee's plan is adequate ( for ~'"'"~--~""2~0~' -' upon receipt by the Council of documentation that the Grantee had adopted its comprehensive plan within nine months after Council review, including required modifications, if any; $__65Q upon submission of the Final Progress Report." Paragraph lB is amended to read as follows: m "The Grantee certifies that of the total actual cost of carrying out the work proqram, no morm than 75% shall have been financed by grant funds awarded by this Agreement, and that no more than 100% shall have been financed by grant funds awarded by this Agreement plus grant funds from other sources of financial assistance." I I I I I I Paragraph iD is amended to include the following: "D. The Grantee agrees to comply with all provisions of the 1976-77 and 1978-79 Grant Guide- lines and the 1980-81 Grant Guidelines, as amended." Par~qr~Fh 5A is ~mended to read: "A. Duration. The period of grant award specified herein shall terminate as of twelve months from the date the Council completes its review of the local unit's comprehensive plan, or upon submission of the final progress report, whichever comes first. Any remaining grant funds awarded to the Grantee by this agreement that have not been disbursed as of that date in accordance with the terms set forth above shall revert to and become part of the Council's local planning assistance fund, and may be reallocated or expended by the Council for pl.anning assistance to other governmental units." Except as hereby amended, the provisions of the above-referenced contract shall remain in force and effect without change.
