CASE REQUEST FOR A HOME OCCUPATION PERMIT; CASE OF SARAH PICKHARDT By: Megan Wald, Associate Planner Background: The City received an application from Sarah Pickhardt for a home occupation permit to establish a one person chiropractic business in her home on the property located at 15751 Potassium Street. The following items are enclosed for your information: a) b) c) d) d) e) Site location map Principal dwelling layout Letter from resident dated April 29, 2004 Draft Planning Commission meeting minutes dated May 6, 2004 Proposed Findings of Fact Proposed Home Occupation Permit Notification: In accordance with State statute, Staff notified property owners within 350 feet of the subject property of the public hearing. Observations: Sarah is proposing to establish a one-person chiropractic business in her home. City Code restricts home occupations to 20% of the gross floor area of the home. The room in which the home occupation will take place is 140 square feet (10 x 14) in size, which is significantly less than 10% of the principal dwelling floor area. The applicant will be the sole employee and expects to service a maximum of 10 clients per week. Operation hours would be primarily Monday - Friday with the last appointment scheduled for no later than 9:00pm, unless under an emergency situation. Tl~e in home chiropractic business will be secondary to Sarah's main employment at Abeler Chiropractic office. The City recently issued a home occupation permit for a massage therapist with similar hours and number of anticipated clients during a week. The Planning Commission held a public hearing and reviewed the request at their May 6, 2004 meeting. There was no public input during the public hearing. The City received a letter from Tom and Betty Greenberg stating their opposition to the home occupation request, however it appears that the opposition is more related to the development of'River Pines, the residential
