City. One mailing was sent for the Comprehensive Plan updatel which included a map showing
proposed changes. Another mailing was sent for the residential'rezonings after the
Comprehensive Plan was adopted; this mailing also included a map showing proposed rezonings.
Mr. Fitzpatrick's property was shown as residential on both of these mailings.
Mr. Fitzpatrick is also asking that the City waive the application fees for the Comprehensive Plan
Amendment and Zoning Amendment.

Recommendation:

While it may not be clear what the exact reason was for changing the subject property's land use
in the Comprehensive Plan, the property has been historically residential and is located directly
on the river. In recent Comprehensive Plan amendment requests, the City Council has indicated a
preference for non-commercial uses directly on the river, with the possibility of changing to a
commercial use if a desirable plan is brought forward by the land owner. The redevelopment of
this parcel for a commercial use may also be constrained by its location directly on the river and
potential need for expanded access to Highway 10.

At their May 6, 2004 meeting, the Planning Commission recommended denial of the
Comprehensive Plan request.

City Council Action:

Motion to adopt Resolution #04-05-
Amendment fi:om Pat Fitzpatrick.

__ denying the request for a Comprehensive Plan

-or~

Motion to adopt Resolution #04-05-__ approving the change from Low-Density Residential
to Places to Shop for the property located at 7150 Highway 10.

Reviewed by:
Community Development Director
Associate Planners

Copies to:
City Attorney

CC: 5/25/04
