Assistant Community Development Director Trudgeon noted that the City Council has expressed <br />that they want this property to remain residential, and Staff has received three letters opposed to <br />the rezoning request. <br /> <br />Citizen Input . <br /> <br />Pat Fitzpatrick stated he is asking for mixed use, not just B-2. He indicated he has aerial photos <br />that show how this lays out. He stated since filling out the application he has spoken with a <br />realtor and believes mixed use is the best zoning. He indicated the letters of opposition say they. <br />do not want a business there, and he can understand that.-He commented the owner at 9340 <br />wanted mixed use and was granted it and not charged for'the change. He stated he is asking for:.: <br />the same thing. <br /> <br />Assistant Community Development Director Trudgeonnoted that the Planning Commission may <br />recall last summer there was a lot of discussion about 9340 and the City Council pursued it. He <br />indicated for a mixed use PUD there is not enough acreage'on 'this parcel so it would have to be <br />B-2. <br /> <br />Chairperson Nixt indicated in the past when they have seen a proposal'they have changed a <br />parcel to mixed use to meet the needs of. the project. He asked if Mr.'Fitzpatrick had a project <br /> <br />Mr. Fitzpatrick indicated he does not. He stated when he titled out the application he wanted B- <br />o but now he wants mixed use. He indicated'~me concern in..a letter was that it would be a car <br />lot, but mixed use would not allow tha{~ icar~!:bt~ are only permitted in B-2. <br /> <br />Motion by chairperson Nixt, seconded bY:Commissioner Brauer to close the public hearing at <br /> <br />Motion carried. Voting Yes: Chairperson, Nixt, Connnissioners Jeffrey, Brauer and Shepherd. <br />Voting No: None. Absent: Commissioners:Johnson, Van Scoy and Watson. <br /> <br />Commission Inpt~t <br /> <br />Chairperson Nixt asked when this zomng was changed to residential. <br /> <br />Assistant Community Development Director Trudgeon replied in December of 2001. <br /> <br />Chairperson Nixt noted the City is currently considering a new Comprehensive Plan amendm, ent <br />that would rezone portions of the city. <br /> <br />Mr. Fitzpatrick stated he asked Staff for the materials that should have been sent, and what he <br />received was what looks like a newsletter. He indicated he does not read the City newsletters, <br />and if he did he would not be able to find his house on the map, and he is 1 ½ miles from the <br />critical boundary area shown, so he would not have thought he Was affected. <br /> <br />Commissioner Brauer asked how far this parcel is from the other property zoned mixed use. <br /> <br />Planning Commission/May 6, 2004 <br /> Page 8 of 25 <br /> <br /> <br />
