CASE <br /> <br /> REQUEST TO REZONE cERTAIN PROPERTY <br /> FROM R-1 RESIDENTIAL TO B-2 BUSINESS; <br /> CASE OF PATRICK FITZPATRICK. <br />By: Patrick Trudgeon, AICP, Assistant Community Development Director <br /> <br />Background: <br /> <br />Patrick Fitzpatrick has requested that the City rezone his property at 91'50 Highway 10 from R-1 Residential to <br />B-2 Highway Business. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Draft Planning Commission Meeting Minutes dated May 6, 2004 <br />c) Proposed Findings of Fact <br />d) Proposed Ordinance <br /> <br />Notification: <br /> <br />State statute requires that property owners within 350 feet of the subject property be notified of the public <br />hearing. A mailing was sent out to affected property owners. <br /> <br />Observations: <br /> <br />As discussed in the previous Comprehensive Plan Amendment case, the subject property's zoning was changed <br />to residential to comply with the 2001 Comprehensive Plan. If the Comprehensive Plan Amendment is <br />approved by the City Council, the property will need to be rezoned to B-2 Business. <br /> <br />Recommendation: <br /> <br />The Planning Commission recommends that the rezoning request be denied. <br /> <br />City Council Action: <br /> <br />Motion to adopt Findings of Fact relating to a request from Patrick Fitzpatrick to rezone the subject property <br />from R-1 Residential to B-2 Business. <br /> <br />-and- <br /> <br />Motion to deny the request to rezone the subject property, based on the Findings of Fact. <br /> <br />-or- <br /> <br />Motion to introduce Ordinance # <br /> <br />Reviewed by: <br />Community Development Director <br /> <br />__ rezoning the Subject Property from R-1 Residential to B-1 Business. <br /> <br /> Copies to: <br /> City Attorney <br /> <br />CC: 05/25/04 <br /> <br /> <br />
