Chairperson Nixt indicated he was just looking at day to day business. He stated special, events <br />may have to be considered appropriately for the first year. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Jeffrey to recommend that City <br />Council adopt Findings of Fact favorable to the applicant relating to a request for an Interim Use <br />Permit to place temporary classroom buildings on the P.A.C.T. Charter'School site unti-I October <br />15, 2004. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Jeffrey and' Shepherd. Voting_ <br />No: None. Absent: Commissioners Johnson, Van Scoy and Watsan. Commissioner Brauer' <br />abstained. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Jeffrey to recm~nr~end that City <br />Council approve the request for an Interim Use P~-mit't0 place temporary classroom buildings on <br />the P.A.C.T. Charter School site until October 15, 2004 and adopt a resolution declaring the <br />terms of the pcnmt, with the following additional conditions: <br /> <br /> I. That not less than 130 parking stalls are available on improved streets or a combination of <br /> improved streets and a temporary parking surface finished with Class 5 materials. <br /> 2. That a partial occupancy perrni:l be r, ec¢ived from the City Building Inspector for access <br /> to the portions of the premises described in the applicant's materials. <br /> <br />Motion canSed. Voting Yes: ChairPerson Nixt, Commissioners Jeffrey, and Shepherd. Voting <br />No: None. Absent: Commissioners Johnson, Van ScoY and Watson. Commissioner Brauer <br />abstained. <br /> <br />Case #3: Public Hearing - Request for Comprehensive Plan Amendment; Case of <br /> Patrick Fitzpatrick <br /> <br />Presentation <br /> <br />Assistant Commun/ty Development. Director Trudgeon advised that the 2001 Comprehensive <br />Plan shows the property located at 9150 Highway 10 as Low Density Residential. Patrick <br />Fitzpatrick resides .on the subject property and recently became aware of the parcel's residential <br />land use designation. He indicated Mr. Fitzpatrick does not agree with the residential <br />designation and is requesting a comprehensive plan amendment to change the land use <br />designation from Low Density Residential to Places to Shop. <br /> <br />Assistant Community Development Director Trudgeon further advised the subject property was <br />designated COlnmercial in the Comprehensive Plan and zoning map prior to the adoption of the <br />2001 Comprehensive Plan. He stated during the adoption of the 2001 Comprehensive Plan a' <br />determination was made to change the area's land use designation from commercial to <br />residential. He indicated Staff was unable to deten'nine the precise rationale for changing the <br />subject property's land use designation to residential, but found that khe residential designation <br />was shown on draft land use maps as early as 1999. He stated it may have been changed to <br />residential because it is surrounded by an existing single-family neighborhood, and the fact that <br />there is cun'ently a residence on the subject property. <br /> <br />Planning Commission/May 6, 2004 <br /> Page 7 of 25 <br /> <br /> <br />
