CASE <br /> <br /> PUBLIC HEARING <br />REQUEST FOR VACATION OF EASEMENTS; <br />CASE OF OAKWOOD LAND DEVELOPMENT, INC. <br />By: Amy Geisler, Associate Planner <br /> <br />Background: <br /> <br />The City Council will tentatively be reviewing the final plat for Alpine Woods as your June 8, <br />2004 Council meeting. The property being platted as Alpine Woods includes underlying drainage <br />and utility easements that were platted as a part of the High Point 2nd Addition subdivision, <br />specifically Lot 2, Block 1. The other 5 lots that will be re-platted as Alpine Woods do not <br />contain any drainage and utility easements. The Alpine Woods development will contain new <br />drainage and utility easements around all common areas, drainage ponds, public utilities, and <br />wetlands. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate easements. <br /> <br />Observations: <br /> <br />It takes a public hearing and Council ordinance to eliminate the underlying drainage and utility <br />easements that exist as part of the original High Point 2nd Addition plat. <br /> <br />Recommendation: <br /> <br />City Staff recommends introduction of the enclosed ordinance to vacate existing easements. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance #04- <br />Point 2''a Addition subdivision. <br /> <br />__ to vacate certain drainage and utility easements in High <br /> <br />Review Checklist: <br /> <br />City Engineer <br />City Attorney <br />Community Development Director <br />Assistant Community Development Director <br /> <br />CC: 05/25/04 <br /> <br /> <br />
