She said that snowmobiles and horses use the boulevard areas for <br />operation and riding. Cunninghams have their yard sodded up to the burb line <br />and there is no ditch. The horse riders told her the city told them they could <br />ride alongside the streets. According to 110.075, Sub. 8 that is true for horses. <br />As for snov~ucbiles, the state statute doesn't address~ municipal right-of-ways <br />other than to prohibit operators ~mder the age of lY+ from operating a snowmo- <br />bile on municipal_ streets or highways (includes right-of-way). <br /> <br />As to the h,rse issue, we haven' t had a problem in the past due to lack of <br />paved streets and even then most areas were paved wher~ there existed obvious <br />ditches. Usually these ditches were ~ot expressly cared for as lawns. Now how- <br />ever we have some areas where the yards go up to the curb, without ditches, and <br />they are usually well cared for with either sod or seed. Therefore to have <br />horses or snowmobiles cruising on those areas will be upsetting to the home- <br />owner. <br /> <br />I'm sure it would be too complicated, if in fact unenforceable, to have an or- <br />dinance apply to some areas and ~ot others so we may have to consider con- <br />fining horses and snowmobiles to the streets only. Tf we do this we can generall2~ <br />beningly neglect enforcement in unplatted, open and unimproved areas where there <br />are no complaints and still have something to use for those who choose t° abuse <br />common sense and property rights, M~be you can toss this around with the council <br /> <br />to get their thoughts since they will have to listen to the citizens whatever <br />is decided.. <br /> <br /> <br />
